Terms and Conditions

1. Product Information:

www.jannicksdrinks.com sells merchandise, wine, and spirits. For further information or questions regarding existing information, please send an email to info@jannicksdrinks.com.

2. Prices:

All prices are fixed and valid on the order date. Prices may change continuously. The buyer will be invoiced at the price valid on the order date, provided that www.jannicksdrinks.com accepts the order. All prices are shown including VAT.

3. Ordering:

The presentation of goods along with a price on www.jannicksdrinks.com is not a binding offer but merely an invitation to make an offer. The buyer’s order of goods from www.jannicksdrinks.com does not constitute a binding acceptance but rather a binding offer to www.jannicksdrinks.com to purchase the item on the stated terms. A binding agreement between the buyer and www.jannicksdrinks.com is only concluded when www.jannicksdrinks.com accepts the buyer’s offer by an order confirmation.

4. Product Range and Items:

Changes in the product range, sold-out items, or items not delivered by the supplier are reserved. www.jannicksdrinks.com will send the best possible alternative if and to the extent that we stock a replacement item on the day, which is deemed to be of the same type and kind. This service can be opted out of. www.jannicksdrinks.com is not obliged to pay compensation or full/partial compensation or reimbursement for missing delivered items. Nor is www.jannicksdrinks.com obliged to compensate or provide full/partial compensation or reimbursement to cover the customer’s loss as a result of non-delivery of items. The specifications of the item in terms of name, type, origin, weight, and/or number of pieces will be as stated by www.jannicksdrinks.com’s supplier. Errors are reserved.

5. Placing Orders:

Orders can be placed at www.jannicksdrinks.com at any time or by email at info@jannicksdrinks.com. Alternatively, orders can be placed by personal service at 53801722 between 09:00 and 16:00 (Saturday 10:00-13:00). When ordering, a minimum delivery time of 2 to 5 days should be expected unless specially agreed terms with our team are arranged. Deviations and the responsibility thereof rest solely with the customer. www.jannicksdrinks.com reserves the right not to deliver a given item if the item is not in stock or there are special requirements for ordering the item, or if www.jannicksdrinks.com cannot reasonably determine which product is desired to be delivered.

6. Payment:

The account information you enter when purchasing goods is sent directly to PBS in encrypted form (SSL) that only you and PBS can read. Therefore, no one else sees or stores the information about you. When purchasing with Dankort or credit card, the amount is deducted from your account as soon as the item departs from www.jannicksdrinks.com.

7. Complaints:

Complaints about defects and deficiencies must be made immediately after delivery. Complaints must be made by contacting www.jannicksdrinks.com at 53801722 between 09:00 and 16:00 (Saturdays between 09:00 and 13:00) or by email to info@jannicksdrinks.com. In the event of defects and deficiencies, www.jannicksdrinks.com has the right, but not the obligation, to redeliver and/or remedy in another way at its own expense within a reasonable time.

Items placed in the webshop’s “cart,” but the order not fully completed and confirmed, will be considered “not placed orders,” and the customer should expect to be charged a fee for the desired subsequent delivery.

Items processed by www.jannicksdrinks.com, including special spirits and juice products, cannot be returned due to customer erroneously placed orders. Items specially sourced or manufactured according to customer’s wishes cannot be returned due to customer erroneously placed orders.

For complaints, www.jannicksdrinks.com reserves the right to require photographic documentation. Items that are discarded/disposed of or otherwise disposed of by the customer without prior agreement with www.jannicksdrinks.com cannot be complained about. Late or insufficient complaints invalidate the customer’s claims. When returning items, www.jannicksdrinks.com is entitled not to credit or reimburse the customer if the returned item is not in the same condition or quality as at the time of delivery.

8. Delivery:

In the event of a failed delivery due to customer-responsible conditions, www.jannicksdrinks.com will be entitled to impose an express fee for possible subsequent delivery. The customer will be informed about this and can therefore opt-out of the delivery/subsequent delivery option.

The items are delivered to the agreed delivery address and within the agreed time interval. The agreed time interval is an intention. www.jannicksdrinks.com is not obliged to pay compensation or full/partial compensation or reimbursement for late or non-delivered items. Nor is www.jannicksdrinks.com obliged to compensate or provide full/partial compensation or reimbursement to cover the customer’s loss as a result of late or non-delivery of items. In any case, www.jannicksdrinks.com’s liability cannot exceed the invoice amount excluding VAT for the respective delivery.

The items are considered delivered, and the risk thus transferred to the customer, when they are made available to the customer at the agreed delivery location, regardless of whether the customer or their personnel are present. Delivery of items will be made according to the customer’s instructions. However, there must be a cleared and prepared area corresponding to the received quantity of items. The customer’s areas and access routes must be accessible, cleared, and safe to traverse. The customer is also obliged to ensure that access routes are cleared of ice and snow. The customer cannot expect delivery of items if it contradicts general practice and/or Danish legislation and occupational health and safety regulations.

9. Disclaimer and Warranty:

Information about the ordered items from external websites does not form part of the description of the ordered items in the agreement between the buyer and www.jannicksdrinks.com; the items meet the buyer’s expectations if they correspond to www.jannicksdrinks.com’s own description. The seller is not liable for direct or indirect loss due to the ordered items arriving late to the buyer or the ordered items having defects when the delay or defects are due to the buyer’s actions or omissions or circumstances beyond www.jannicksdrinks.com’s control, such as war, riots, disturbances, fire, state intervention, seizure, currency restrictions, labor disputes of any kind, including strike and lockout, or similar. www.jannicksdrinks.com does not provide any independent warranty for the ordered items, and the buyer only obtains the guarantees that the manufacturer issues to the buyer.

10. Product Liability:

www.jannicksdrinks.com’s liability for property, movable property, and personal injury is generally limited to incidents and damages that can be proven to be caused by errors or omissions made by www.jannicksdrinks.com. www.jannicksdrinks.com cannot be held liable for the customer’s possible operating loss, loss of profit, or other indirect losses.

11. Packaging and Transport Material:

If and when www.jannicksdrinks.com delivers items in cages, pallets, or other reusable materials, these delivery materials are considered www.jannicksdrinks.com’s property and are solely made available to the customer. The material must be placed so that www.jannicksdrinks.com regularly has the opportunity to take the material back. Plastic and metal packaging and delivery materials marked by or belonging to another catering, food service, or producing company are not taken back unless the packaging or material was delivered by www.jannicksdrinks.com. If the material is lost, www.jannicksdrinks.com is entitled to charge payment for it.

12. Reservation for Changes:

www.jannicksdrinks.com reserves the right to change and update the rules and conditions applicable to this website. It is therefore important that you continuously stay informed about any changes.

13. Returns:

In accordance with Danish and EU regulations, customers have the right to return goods purchased online within 14 days of receipt without providing a reason. The following conditions apply to returns:

1. The right of withdrawal is valid for 14 days from the date you receive the item.
2. To exercise the right of withdrawal, you must notify us within 14 days of receipt by email at info@jannicksdrinks.com. You must then return the item within 14 days of notifying us.
3. The item must be returned in the same condition and quantity as received. The item should not have been used in a manner beyond what is necessary to determine its nature, characteristics, and functioning.
4. You bear the cost of returning the item unless otherwise agreed.
5. Upon receipt and inspection of the returned item, we will refund the purchase price (including the original delivery costs) within 14 days. The refund will be processed using the same payment method used for the original transaction unless otherwise agreed.

Exceptions to the right of withdrawal:

• Custom-made products or products clearly personalized for the customer.
• Sealed goods that are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery.
• Goods that are likely to deteriorate or expire rapidly.
